Company offence → Company + responsible persons.

Section 58D — Section 58B not applicable to Section 42

🔥 Small but exam-worthy.

Section 58B does not apply to matters dealt with in Section 42.

Why important?

Because Section 42 has its own penalty mechanism.

Section 58E — Cognizance of offences

Court cannot take cognizance of RBI Act offence unless:

  • Written complaint by authorised RBI officer.

Trial:

  • Metropolitan Magistrate
  • Judicial Magistrate First Class
  • Higher court.

For specified serious contraventions:

  • Up to ₹10 lakh or
  • Twice amount involved, where quantifiable,
    whichever is higher.

Continuing contravention:

  • Additional penalty per day.

NBFC must get:

  • Show-cause notice
  • Reasonable opportunity of hearing.

Critical distinction

58B = statutory criminal penalties

58G = RBI’s direct monetary penalty power for NBFCs

Sections 59–61

Status

Repealed.

Historical provisions dealing with:

  • Amendments/repeals to other legislation.

THE TWO SCHEDULES

First Schedule

Deals with:

Areas served by Local Boards.

Remember

S.9 + First Schedule = Local Boards.

Second Schedule

Deals with:

Scheduled Banks.

Remember

A bank included in Second Schedule = Scheduled Bank under Section 2.

And then:

Scheduled Bank → Section 42 → CRR obligation with RBI.

🧠 The conceptual map you should actually memorise

Don’t memorise 100 isolated sections. Memorise the chain of RBI powers:

RBI itself

3 → 7 → 8 → 17 → 19

Establish RBI → manage RBI → constitute Board → what RBI can do → what RBI cannot do.

Currency

22 → 23 → 24 → 25 → 26 → 27 → 28

Issue → Issue Department → denomination → design → legal tender → reissue → mutilated/lost notes.

Scheduled Banks

42 → 43

CRR → consolidated reporting.

Credit information

45A → 45B → 45C → 45D → 45E

Define → collect → call returns → furnish → maintain confidentiality.

NBFC regulation

45IA → 45IB → 45IC → 45ID → 45IE → 45JA → 45K → 45L → 45MA → 45MB → 45MBA → 45MC → 45N

Register → Liquid assets → Reserve → Remove director → Supersede Board → Advertisements → Deposits → Financial institutions → Auditor → Stop deposits → Resolve → Wind up → Inspect

This sequence is gold for an inspection/regulation-oriented exam.

Monetary policy

45ZA → 45ZB → 45ZC → 45ZD → 45ZE → 45ZI → 45ZK → 45ZL → 45ZM → 45ZN

Target → MPC → Eligibility → Tenure → Removal → Meeting → Decision → Minutes → Report → Failure

That is the entire monetary-policy framework in one chain. The Act specifically provides for a six-member MPC, four-year non-renewable tenure for Government-appointed members, at least four meetings annually, four-member quorum, majority voting with Governor’s casting vote, publication of decisions/minutes, six-monthly Monetary Policy Reports, and a failure report when the inflation target is not achieved.

One warning for your exam or interview preparation

The uploaded document is the RBI Act as amended through the Finance Act, 2022. The document itself lists Finance Act, 2022 as its latest amending enactment.

So don’t blindly use the numerical values in this document as if they are necessarily the currently applicable operational RBI regulations in 2026. The Act often gives RBI power to prescribe the actual percentage/rate/conditions through regulations or notifications. Act provision ≠ current RBI regulatory prescription.

That distinction is exactly the kind of thing a promotion-exam paper setter will exploit.

If your goal is the RBI Grade B Exam or Interview, the next useful step is to turn this into a “Section → Exact provision → Simplified meaning → Number/Time limit → Exam trap → Memory trick” master revision table, because that will be far more useful for revision than reading the bare Act repeatedly.
